GENERAL LEGAL INFORMATION



This page contains information relevant to the legal requirements of Deloaks Subdivision.

All homeowners should be aware of the restrictive covenants of the subdivision.

When Deloaks Subdivision was developed in 1984, Covenants, Deed Restrictions, and Obligations were filed with St. Tammany Parish.

The Architectural Control Committee (ACC) was established to maintain the quality and desirability of Deloaks Subdivision. All improvements on the lots were then and are now to be constructed with strict adherence to the covenants, and hereafter maintained by the owner in a clean, safe, and attractive condition and in good repair.

All members of the ACC committee and the Deloaks Subdivision Board are volunteers. Our goal is to continue to maintain Deloaks Subdivision as a quality subdivision. The cooperation and assistance of all residents are requested.

Responsibilities for Maintenance of Subdivision Drainage Ditches




Based upon Legal research performed by attorney Alvin Dupre November 2016:

"On December 15, 1994, the St. Tammany Parish Police Jury adopted Ordinance No. 2354 (Inst. #941059). The Ordinance provides:

WHEREAS, it has been agreed that DelOaks property owners association will retain ownership and maintenance obligation of all outfall ditches, and the parish will only assume responsibility for roadside ditches; and

WHEREAS, it is understood that the existing two traffic islands will remain within the existing street right-of-way, however, maintenance of same shall be the responsibility of the DelOaks property owners association.

The Ordinance then provides: All of the area within right-of-way, the road base, surface, drainage ditches, culverts, laterals, canals, and appurtenances thereunto belonging to or otherwise appertaining to DELOAKS SUBDIVISION shall be incorporated into the parish selective maintenance system, UPON DONATION OF RIGHT-OF-WAY TO THE PARISH BY OWNER, and subject to the stipulations indicated above; EXCLUDING THE FOLLOWING: 1) ALL OUTFALL DITCHES; 2) MAINTENANCE OF TRAFFIC ISLANDS."

Thus, St. Tammany Parish has responsibility for maintenance of the streets and the roadside ditches. The other ditches which are called "outfall ditches" remain the responsibility of the HOA.
